Terms of Service

1. Acceptance
By accessing or using Outbound ("the Service"), you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. The Service
Outbound provides an AI-powered email sequencing and outreach automation platform. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to subscribers.
3. Acceptable use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including CAN-SPAM, GDPR, CASL, and any other applicable anti-spam or data protection regulations. You must not use the Service to:
- Send unsolicited bulk email to contacts who have not opted in or for whom you do not have a lawful basis to contact
- Transmit illegal, harmful, or harassing content
- Impersonate any person or entity
- Attempt to gain unauthorized access to the Service or its infrastructure
- Use the Service to violate anyone's privacy rights
We may suspend or terminate accounts that violate these terms without prior notice.
4. Subscription and billing
Subscriptions are billed monthly in advance. Prices are as listed on the Pricing page. We reserve the right to change prices with 30 days' notice. Cancellations take effect at the end of the current billing period — you won't be charged again, and you retain access through the period you've paid for.
5. Data and ownership
You retain all rights to the data you upload to the Service (contact lists, email copy, etc.). You grant us a limited license to process that data solely to provide the Service. We do not claim ownership of your data and do not use it for any purpose beyond operating the Service on your behalf.
6. Intellectual property
The Outbound platform, including its software, design, and documentation, is owned by Outbound and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
7. Disclaimer of warranties
The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding uptime, accuracy of AI-generated content, or fitness for any particular purpose. Email deliverability depends on factors outside our control including recipient mail servers and sending reputation.
8. Limitation of liability
To the maximum extent permitted by law, Outbound's total liability for any claims arising from use of the Service is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
9. Governing law
These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
10. Changes to these Terms
We'll provide at least 14 days' notice before material changes take effect, by email to your registered address. Continued use after the effective date constitutes acceptance.
